Check the trigger first
Confirm the notified sum, the final date for payment and that no valid pay less notice arrived. Suspending without the right is itself a breach.
Give at least seven days
In writing, stating the ground, served the way your contract says notices are given. Keep proof of when it arrived.
Plan the restart
The right ends the moment the sum is paid in full, so plan the return to site when you plan the suspension.

Can I suspend work for non-payment?
Yes, under section 112 of the Construction Act. The notified sum must be unpaid by the final date for payment, with no effective pay less notice, and you must give at least seven days' written notice.
How much notice do I have to give before suspending?
At least seven days, in writing, stating the ground on which you intend to suspend.
Can I suspend only part of the work?
Yes. Section 112 allows suspension of any or all of your obligations under the contract.
Can I claim the cost of suspending?
Yes. The party in default is liable for a reasonable amount in respect of costs and expenses reasonably incurred as a result of the suspension.
Do I get extra time for the suspended period?
Yes. The period of suspension is disregarded when computing any contractual time limit for completing the work affected.
